About this archive

This website is the personal photographic archive and publishing platform of Ronan O’Cuillinn.

It presents street, documentary and artistic photography created as part of an ongoing body of photographic work. Many photographs are made in public spaces and some may contain identifiable individuals.

The purpose of publishing these photographs is artistic, documentary and expressive. They are not published for the purpose of identifying, profiling, monitoring or commercially exploiting individuals appearing in the images.

Photography, personal data and artistic expression

Where a photograph contains an identifiable individual, the image may constitute personal data under applicable data-protection law.

The publication and processing of photographs on this website is undertaken in the context of freedom of expression and artistic expression.

Where applicable, consideration is given to section 43 of the Data Protection Act 2018, concerning the processing of personal data for the purpose of exercising the right to freedom of expression and information, including artistic expression.

Section 43 is considered on a case-by-case basis. It does not constitute a blanket exemption from data-protection law, and the circumstances surrounding an image and its publication remain relevant.

Requests concerning photographs

If you appear in a photograph published on this website and believe that its publication raises a genuine privacy or data-protection concern, you may contact me at:

admin@ronanocuilinn.com

When considering a request, I may take into account matters including:

  • the circumstances in which the photograph was made;
  • whether it was made in a public place;
  • the artistic or documentary context of the photograph;
  • the nature and extent of its publication;
  • the rights and interests of the person concerned;
  • freedom of expression and artistic expression; and
  • applicable Irish and European data-protection law.

Where appropriate, I may consider removing, replacing, cropping or otherwise modifying an image.

A request for removal does not automatically mean that a photograph will be removed. Each request will be considered on its individual circumstances, including any relevant artistic, documentary and freedom-of-expression considerations.

Children and vulnerable individuals

Particular care is taken when considering the publication of photographs involving children or individuals in potentially sensitive or vulnerable circumstances.

Photographs will not knowingly be published where their publication would create an unjustified or disproportionate intrusion into an individual’s privacy or otherwise conflict with applicable law.

Your data-protection rights

Depending on the circumstances and the applicable law, individuals may have rights concerning the processing of their personal data.

Some of these rights may need to be balanced against other rights and legal interests, including freedom of expression and artistic expression.
